Düsseldorf, August 7, 2018 – Asahi Kasei received the Altair Enlighten Award 2018 in the Enabling Technology category for a glass fiber reinforced polyamide 66 pedal bracket developed jointly with Mazda Motor Corporation. The award ceremony was held in Michigan, the US, on July 30, 2018.

The Altair Enlighten Award is presented by Altair Engineering Inc. in collaboration with the Center for Automotive Research (CAR), media partners SAE International, and media sponsor Automobil Industrie. The award in the three categories of Full Vehicle, Module, and Enabling Technology is given to automotive manufacturers and suppliers to honor innovative achievements in vehicle lightweighting.

Asahi Kasei“s Leona™ polyamide 66 with glass fiber reinforcement was used to develop a substitute for metal brackets installed in an existing model of a Mazda vehicle. Asahi Kasei“s topology optimization technology, a kind of computer aided engineering (CAE), was used to achieve innovative design of the part, enabling an 83% weight reduction. Asahi Kasei received the Award in recognition of this remarkable development.

Berlin, August 07, 2018. Influencer marketing has become one of the most important areas of activity for marketers in the digital sphere and is about to evolve into a billion euro market in Germany, Austria and Switzerland (DACH), a new study by German management consulting firm Goldmedia shows. According to the report, around 30,000 German-speaking Instagrammers, YouTubers, etc. were active in the DACH region in 2017 and generated a total net revenue (monetary and non-monetary) of MEUR 560. Over the next few years, the market is likely to experience annual growth of 20% and generate nearly BEUR 1 by 2020. Influencer marketing is therefore no longer considered to be a marketing trend; it has now become mainstream.

If professionalization within the industry continues and overall macroeconomic development in the Eurozone remains stable, then the influencer marketing market could be valued at more than MEUR 800 in Germany alone by 2020. This would then amount to one sixth of the net revenue generated via TV advertising in Germany.

These are some of the results revealed by the new market study „Influencer Marketing in the DACH Region: Market Structure, Size and Future Outlook“ conducted by Goldmedia www.Goldmedia.com, a research and management consulting group based in Germany. The study provides the first authoritative and detailed analysis of the market for influencer marketing in the DACH region.

++ Influencers generate most of their revenue on YouTube and Instagram

The Goldmedia study focuses on primary personal influencers who have at least 10,000 followers on their social media profiles. These influencers“ sources of income are diverse: in addition to receiving direct payment for sponsored photos, videos or stories, influencers also receive both monetary and non-monetary rewards, such as payments from affiliate programs, free samples of products, invitations to events, travel allowances etc. However, direct monetary compensation that influencers receive for sponsored posts is by far the predominant source of revenue.

Instagram and YouTube are the most important social media platforms for influencers, with more than half of the total revenue from sponsored posts being generated via these social media platforms (see chart below).

++ The market needs to see professionalisation in terms of stakeholder roles and standards

Influencer marketing has left the experimental phase and has instead become an integral part of an increasing number of organisations“ marketing activities. However, the parties and processes involved need to undergo further professionalisation in order to ensure sustainable market growth. This includes, but is not limited to, the influencers themselves. For example, influencers should focus on one field of interest instead of cooperating with organisations from many different industries. Furthermore, promotional content on influencers“ channels needs to be delineated more clearly and consistently, otherwise influencers risk losing their most important assets: authenticity and trustworthiness.

Which Investment is better: Real Estate or Stocks?

In all likelihood, each one of us has already formed an opinion and an answer to this bold question. But of course, opinions are, almost always, neither the truth nor the hard facts. Since TERRA INTERNATIONAL REALTY has maintained a respectable position in the real estate industry, it is extremely necessary that every article involving statistical data and information are properly backed-up by respectable entities or institutions.

Based on an extensive study made by a team of economists from the University of California, the University of Bonn, and the German central bank, they came up with a stunning analysis from 145 years of economic data of leading authors who conducted the study (The Rate of Return on Everything, 1870-2015.). That research has reported a comparative study of returns on equities, residential real estate, short-term treasury bills and longer-term treasury bonds. The study included adjusted inflation rates, all returns, depreciation and appreciations, dividend income for equities and rental income for residential real estate.

In short, residential real estate had the best ROI at an average of 7%/annum, followed by Equities as the graph shows, then came bonds and bills with much lower returns.

Remember these are long-term averages and over many decades, there were some dramatic changes. By 1980-2015, equities performed better than real estate. Among the 16 countries studied, equities had an average annual return of 10.7% against real estate at 6.4%.

Does this mean we have to sell our real estate and buy stocks then? Of course not. First, only a few countries threw off the average returns from 1980-2015. Japan“s real estate markets collapsed due to its aging population. Germany has been in a slump for decades. Meanwhile, in Scandinavia, equities were on a rise. But, let us check the risk and volatility factor, which is a more interesting picture for an investor. And here is a quick look:

-Treasury bonds are low-risk, low -return and no one can challenge that truism
-Equities are high risk, high return. This is rather interesting since we saw how stock markets have performed for the last century. It“s up to 29% one year and down 18% the next year. This would erase the idea that equities are not risky and volatile type of investment.

That brings us back to the basic principles of economics that when the demand is low; prices go down as well. A higher demand will, naturally, bring prices up. But what if the demand was so great that it depletes the supply so fast. Therefore, the assumption is, if an asset is low-risk but high return, everybody will be going for it until it drains faster than flushing a toilet bowl. Luckily, that assumption doesn“t seem to be true for residential rental properties, which is low risk, high returns.

In recent years, residential real estate has maintained high returns with low risk, until the past ten years where real estate has become expensive. You just cannot invest $100 which you can do with buying stocks. Even if you can borrow or mortgage a property you still have to put up about 20% down plus some documentary costs and all that.

In other words, real estate investing has a stiffer requirement in terms of financing. It is also difficult to branch out to other investment scenario assuming that you need a $20,000 cash for every asset. Real estate is also illiquid, as you can“t buy it now and sell it tomorrow. It usually takes months to do either one. And that is also the reason why it is more stable than equities or stocks.

Those who did not like the look of real estate returns compared to stock returns for the past few decades should consider the Sharpe ratio which has grown stronger over time. Since 1950, this ratio had averaged an impressive .8%. It showed that the high bond yields of the 1980s were actually the problem itself, if you“ll look at bond returns over the past 145 years. There were more periods they earned negative returns. The following are a few reasons why rental properties are better investments than bonds:
-Bonds pay out for a specific period then stops paying. In other words, they expire.
-Rental properties keep paying indefinitely.
-Bonds become less valuable with their purchasing power due to inflation.
-Rental costs rise along with inflation.
-Fixed mortgage or borrowed money from banks goes down over time, until one day it“s all over while your rental cash flow keeps on multiplying.

Power of attorney can constitute a valid will

It is possible for a power of attorney to constitute a valid will. That was the verdict of the Oberlandesgericht (OLG) Hamm, the Higher Regional Court of Hamm, in a ruling from May 11, 2017 (Az.: 10 U 64/16).

A will should always be clearly recognizable as the testator“s final wishes to prevent disputes from arising among the heirs. We at the law firm GRP Rainer Rechtsanwälte note that it will ideally have an unambiguous heading such as „my will“ or „my final wishes“. That being said, even personally prepared documents that, for instance, feature the heading „Vollmacht“, i.e. „power of attorney“, are capable of constituting a valid will. That was the verdict of the Oberlandesgericht Hamm in a recently published ruling.

In the case in question, the testatrix had drafted a testamentary disposition featuring the heading „Testament“ (will) in which she provided that her two sisters were to inherit half of her detached house each. Only a few days later, the testatrix prepared another document with the heading „Vollmacht“ in which she granted her niece power of attorney in relation to her savings contract with a building society, her checking account, savings book and financial investments beyond her death and to have the balances paid out to her.

There was no disagreement regarding the fact that the testatrix had designated her sisters as co-heirs to half of the estate each as per the will, as the house represented the testatrix“s main asset. The probate court issued a certificate of inheritance accordingly.

What was disputed, however, was whether the testatrix“s niece was entitled to inherit. The latter argued that her aunt had allocated the balances to her as legacies and that the second document was not merely a power of attorney but rather a will. The OLG Hamm found in the niece“s favour, concluding that the power of attorney granted constituted a valid will. The Court went on to say that it had been personally written and signed by the testatrix, and thus met the formal requirements for it to be a will. Moreover, it was possible to identify a serious intention to make a will; the fact that the document featured „Vollmacht“ as its heading did not, according to the OLG, count against this, because it was already clear from the will that the testatrix was not familiar with the usual wording associated with a testamentary disposition. It could therefore be assumed that the testatrix had wanted to bequeath the balances to her niece.

A will should always be clearly worded to ensure that testamentary dispositions are in fact capable of being implemented in accordance with the wishes of the testator. Lawyers who are experienced in the field of succession law can offer advice.

IBC 2018: Draka shows UHD series for transmission of 4K signals

Cologne, August 2nd, 2018. Draka presents the UHD cable series for the transmission of 4K signals at this year’s IBC. The cable manufacturer will also be exhibiting the entire range of coaxial cables for the 1080i, 720p and 1080p transmission standards. The international trade fair for media, entertainment and technology will take place from 14th to 18th September in Amsterdam.

Draka presents the broadcast standard of the future at IBC 2018 with its UHD series for 4K applications. According to SMPTE ST 2082, the format transmits 4K video signals with a resolution of 3840 x 2160 pixels and a data stream of 12 Gbit/s. This corresponds to a half clock frequency of 6 GHz. The standard also provides for a maximum allowed attenuation of 40 dB. Draka has developed coaxial cables for 4K applications based on these specifications.

For example, the new UHD series includes the UHD50 and UHD100, which Draka designed with the needs of OB truck manufacturers in mind, such as compliance, with outer cable diameters of 4.5 and 7 millimeters. Draka has achieved this through higher dielectric foaming and a silver-plated, size-optimized, inner conductor.

„A discussion is currently taking place on the market about higher data streams. 4K is playing an ever-increasing role in this. Currently, 4K transmissions in Quad Link (4 x 3 Gbit/s) are carried out for technical reasons. In practice, however, this proves to be uneconomical. A single link transmission at 12 Gbit/s is desirable“, explains Marc-Oliver Hentschel, Product Manager Broadcast at Draka.

Visitors will also have the opportunity to find out about the entire portfolio of coaxial cables for 1080i, 720p and 1080p video signals. For example, via the 0.6/2.8AF cable, which is typically used in the infrastructure of OB trucks and enables a cable length of up to 90 meters.

If there is reason to suspect that management has breached its duties, the shareholders of a GmbH, a type of a German private limited company, can request that a special audit be carried out.

We at the commercial law firm GRP Rainer Rechtsanwälte note that the responsibilities of the shareholders of a GmbH include approving the annual financial statement as well as scrutinizing and monitoring management. In a judgment from December 14, 2017, the Oberlandesgericht (OLG) München, the Higher Regional Court of Munich, ruled that the right to scrutinize and monitor management also encompasses the right to appoint special auditors (Az.: 23 U 1481/17).

According to the OLG München“s ruling, a special audit is only impermissible if the application for its implementation is unlawful and constitutes a breach of a fiduciary duty by the shareholder filing the application. Moreover, the implicated shareholder has no voting rights in relation to the preparatory actions and decisions taken in respect of a special audit.

If shareholders of a GmbH are concerned that management has breached its duties, they can request a special audit. For the purposes of adopting a resolution, a simple majority is sufficient. In the case before the OLG München, two families with equal shares in a GmbH & Co. KG, a type of limited partnership with a GmbH as general partner, as well as a Komplementär-GmbH, a.k.a. a general partner GmbH, had fallen out. One of the families filed for a special audit and later voted in favour of this measure, whereas the other family voted against it. The managing director was not entitled to vote and the resolution concerning a special audit was passed.

The managing director then raised a legal complaint against this. However, the lawsuit was largely unsuccessful. The OLG München held that the shareholders of a GmbH are entitled to appoint special auditors. It ruled that in order for this to happen it is necessary for a tangible cause informed by the facts and circumstances to be presented to the general meeting of the shareholders. The Court noted that the suspicion of a breach of duty by management must follow from these facts and circumstances. Furthermore, the special audit must prove to be expedient in the form in which it was specifically requested. The Court went on to say that a special audit is only impermissible if the application is unlawful and constitutes a breach of a fiduciary duty by the shareholder filing the application.

Disputes among the shareholders of a GmbH are a regular occurrence. If these differences of opinion cannot be cleared up, lawyers who are experienced in the field of company law can offer advice and recommend targeted resolutions.

In its survey, the „Deutschland Test“ institute, with the scientific support of the International School of Management (ISM), evaluated data from Germany’s 5,000 biggest companies. With immediate effect, estos facilitates the launch of ProCall Enterprise features beyond the company’s own internal network. This includes working while on the road or connecting from the workstation at home, as well as communication via websites including audio/video chat. On the cloud platform UCConnect, developed for this purpose, estos resellers or end-user companies can choose online services for themselves or their customers. Companies can use these services with little resources and minimal technical know-how. The portal not only simplifies setup but also reduces any adjustments needed to the customer infrastructure. „As soon as there is a connection between the internal company network and outside, the software setup becomes more complicated,“ explains Raphael Bossek, product manager at estos. „For example, the firewall must be bridged without creating a security risk. Different possibilities are available here. The simplest solution for our customers is to use our UCConnect services.“ The software procured via the cloud portal is permanently up-to-date with the latest technology and any respective security requirements.

ProCall Web Communication Services help companies get started with the contact portal and multimedia business card in ProCall Enterprise: The multimedia business card can be sent as a link, added to the e-mail footer or printed on a business card. It refers to a personal web-based profile page on the internet with availability and contact information as well as all contact possibilities. The contact portal presents selected employees via the website and additionally provides presence information and contact options. Visitors reach a suitable contact person via text, audio and audio/video chat. ProCall Mobility Services facilitate the setup for working out of office and at home. With the ProCall Mobile apps or working from home, users can access unified communications features. These include, for example, presence management, important data on business contacts, video chat or the integration of softphone functions.

The hybrid cloud building blocks ProCall Mobility Services and ProCall Web Communication Services are now available. Companies that are interested can first test the online services for 45 days before switching to live-operation.
